Lost Prop 13 base year

Parent-to-child transfers preserve the original base year — only if BOE-19-P is filed within 3 years. Miss it, the property resets to market value. Permanently.

City conveyance tax charged unnecessarily

San Jose, Palo Alto, and Mountain View are the ONLY California cities charging extra city conveyance tax — $1.65 per $500. Spousal and trust transfers are exempt with the right recital under R&T §11930 / §11911.

Prop 19 cap exceeded

The parent-child exclusion protects only base year + $1,044,586 (2025-27 cap). Over that, the difference is reassessed.

Interspousal document — exempt from reassessment under R&T §63. Recorded same day.

Parent-to-child or child-to-parent

Prop 19 limits the exclusion to a child's primary residence. We prepare the BOE-19-P claim with the deed so the exemption is filed on time.

Funding a living trust

An unfunded trust doesn't avoid probate. We prepare the trust transfer document that moves your home into the trust — R&T §62(d) excluded from reassessment.

LLC or entity transfer

Moving property into an LLC, partnership, or corporation. We prepare the grant deed with proper authority recital and check Prop 13 implications under §64.

Sibling or co-owner transfer
