Common Reasons

Every petition has a story behind it

Californians file a Petition for Change of Name for a wide range of personal, family, and documentation reasons. Below are the most common circumstances we see at our San Jose office. Whatever your reason, our Registered Legal Document Assistant prepares the paperwork at your direction so the court has everything required.

Client reviewing name change documents at TrustPoint office in San Jose

Misspelled at Immigration

A missing diacritic, a reversed given name and surname, or a phonetic spelling that never matched the birth record — corrected through a court decree.

After Divorce

Restoring a former name when it wasn't included in the divorce judgment, or taking a completely new name after the marriage ended.

Birth Certificate Correction

Wrong father listed, mother's maiden name used instead of a chosen surname, or a clerical error made at the hospital. These are common reasons clients file a Petition for Change of Name.

Marriage or Domestic Partnership

Many marriage-based name updates can be made using the certified marriage certificate without a court petition. When a couple decides a court petition is the path they want, we prepare the documents.

Minor or Child's Name

Parents or guardians changing a child's name — with or without the other parent's consent. Extra service and notice steps apply when a parent objects.

Personal or Identity Reasons

Reclaiming a birth name, adopting a chosen name, aligning documents with gender identity, or simply a fresh start that reflects who you are today.

Start to Finish

How the petition moves through court

Five stages from the moment you walk into our San Jose office to the day you hold your certified Decree Changing Name.

1
Day 1 · Intake

Consultation & questionnaire

We record your current legal name, the new name you want, and the reason as you describe it. For minors, we note the consent status of both parents. If you also want immigration form preparation or a deed update after the decree is signed, we'll note that at intake as well.

2
Week 1 · Preparation

Petition and supporting forms drafted

Our Registered LDA prepares the Petition for Change of Name, Attachment listing each name to be changed, Order to Show Cause, Decree Changing Name, and Civil Case Cover Sheet. For minors, a supplemental attachment is prepared for each child. You review and sign.

3
Week 2 · Filing

File at Santa Clara County Superior Court

The petition is filed at the courthouse and the ~$450 filing fee is paid (or a fee waiver application is filed if the client qualifies). The clerk issues a hearing date and a stamped Order to Show Cause. When the court requires Live Scan fingerprinting, it is coordinated through our partner Bay Area Live Scan & More.

4
Weeks 3–7 · Publication

Newspaper publication for four consecutive weeks

California law requires the Order to Show Cause to be published in a newspaper of general circulation once a week for four weeks. We coordinate with a qualified Santa Clara County publication and collect the Proof of Publication for the court. Some petitions — such as those to conform to gender identity or for Safe-at-Home participants — are exempt.

5
Weeks 8–12 · Decree

Judge signs the Decree Changing Name

If no written objection is filed at least two court days before the hearing, the judge commonly grants the petition without a personal appearance. You receive certified copies to update Social Security, DMV, passport, bank, and employer records.

After the Decree Is Signed

Where clients commonly use the certified copy

Once the judge signs the Decree Changing Name, the certified copy is what agencies accept as proof of the name change. Most agencies require an original certified copy, and TrustPoint can order copies on the client's behalf.

  • Social Security — new card issued with the same number, typically same day at a local SSA office.
  • California DMV — driver's license and Real ID updated with the certified decree and SSA confirmation.
  • U.S. Passport — updated through the U.S. State Department with the certified decree enclosed alongside the appropriate renewal or correction application.
  • USCIS & Immigration — green card, naturalization certificate, and work authorization — we prepare the supporting forms.
  • Deeds & Title — property recorded under the prior name updated through our deed transfer service.
  • Estate Plan — trusts, wills, and power of attorney re-issued through our Trustate estate planning service.

Questions, Answered

The things clients ask first

How much does a name change cost in California?

Santa Clara County Superior Court charges approximately $450 to file a Petition for Change of Name. Newspaper publication of the Order to Show Cause typically runs $80 to $150 depending on the publication. The California courts make a fee waiver application available to those who qualify based on income. TrustPoint's document preparation fee is $500, flat, quoted in writing before any work begins — book a consultation here.

How long does the process take in Santa Clara County?

According to Santa Clara County Superior Court procedures, a typical adult petition moves from filing to signed Decree Changing Name in about 8 to 12 weeks. That window includes four consecutive weeks of newspaper publication, court review, and the judge's signature. Petitions involving minors, non-consenting parents, or missing records generally take longer.

What documents does TrustPoint prepare for a name change?

At the client's direction, TrustPoint prepares the complete petition package required by Santa Clara County Superior Court — the Petition for Change of Name, the Attachment identifying each name to be changed, the Order to Show Cause, the Decree Changing Name, and the Civil Case Cover Sheet. Minor petitions add supplemental attachments, and proof-of-service documents are prepared when service is required. Gender-identity petitions use a different petition form, which TrustPoint also prepares.

Does California require a court petition after marriage?

California law permits a spouse to use a certified marriage certificate to update Social Security, DMV, and U.S. State Department records after marriage. A separate Petition for Change of Name is the court process governed by Code of Civil Procedure sections 1275 through 1279.6 and is a different procedure from a marriage-based update. TrustPoint prepares whichever documents the client directs us to prepare.

What are the options for restoring a former name after divorce?

Under California law, a divorce judgment that restored a former name is itself sufficient to update records. When a judgment did not restore the former name, an Ex Parte Application for Restoration of Former Name After Entry of Judgment is available in the court of the original divorce. TrustPoint prepares either of these documents at the client's direction.

What if a name was misspelled during immigration to the United States?

A Petition for Change of Name filed in California produces a court Decree Changing Name, which is the court-issued record of the legal name. Some clients also pursue birth certificate amendments or USCIS record updates. TrustPoint prepares the supporting documents for each of these procedures at the client's direction through our immigration service. The client decides which procedure to pursue.

Can a parent petition to change a child's name in California?

Yes. California law permits a parent or legal guardian to petition for a minor's change of name. When one parent does not consent or cannot be located, the non-consenting parent must be personally served with the Order to Show Cause at least 30 days before the hearing, and the court decides based on the best interest of the child. TrustPoint prepares the petition and service documents at the client's direction.

Is a court appearance required in Santa Clara County?

Under Santa Clara County Superior Court procedures, an adult petition may be decided on the paperwork alone if no written objection is filed at least two court days before the hearing. Contested petitions, minor petitions with non-consenting parents, and petitions flagged by the confidential background review typically require a personal appearance. The court makes that determination, not TrustPoint.

Is fingerprinting required for a name change petition?

Santa Clara County conducts a confidential background review on adult petitions, and a Live Scan or fingerprint card may be required in certain cases. When the court requires it, Live Scan fingerprinting is available through our partner Bay Area Live Scan & More, which operates from the same office.
