Under Proposition 13, transferring property into your own revocable living trust does not trigger property tax reassessment. Proposition 19 (effective February 2021) changed parent-to-child exclusion rules but did not eliminate the exclusion for transfers into your own trust — your Prop 13 base year value is preserved. What is a trust deed transfer?
A trust deed transfer records a new deed with the county that moves property ownership into or out of a living trust. Without this recorded deed, property titled in your personal name will go through California probate — even if you have a trust.
Will my property taxes increase?
No. Under Proposition 13, transferring property into your own revocable living trust is automatically excluded from reassessment. Proposition 19 (2021) changed parent-child exclusion rules but does not affect transfers into your own trust. We prepare the PCOR with the proper exclusion codes and file it with the county recorder to protect your property taxes.
Can you record in any California county?
