What Is a General Conservatorship?

A general conservatorship (sometimes called a probate conservatorship) is established when an adult can no longer manage personal, financial, or medical decisions on their own. The Santa Clara County Superior Court appoints a responsible adult (the conservator) to act on behalf of the conservatee.

Filing for a General Conservatorship

To begin, you must file the following documents in Santa Clara County Probate Court:

Power of Attorney vs. Conservatorship What’s the Difference?

  • Signed voluntarily by the adult while they still have decision-making capacity

  • Grants authority to an agent for financial or healthcare decisions

  • Can be revoked at any time if the adult remains competent

    • Ordered by the court when the adult no longer has legal capacity

    • Appoints a conservator with ongoing court supervision

    • Cannot be revoked by the conservatee once approved

    Key Point: If a valid power of attorney exists, conservatorship may not be necessary. But when an adult is already incapacitated, the court requires conservatorship instead.
