We cannot give legal advice, opinions, or recommendations to consumers about possible legal rights, remedies, defenses, options, selection of forms, or strategies. TrustPoint Disability & Legal Services LLC is not a law firm and is not licensed to practice law in California or any other jurisdiction. Our staff are not attorneys.

By California law, we cannot: provide legal advice, opinions, recommendations, or strategies; explain your legal rights or remedies; tell you which forms to file or how to answer specific questions; select forms for your matter; represent you in court; negotiate on your behalf; or predict the outcome of your case.

If you require legal advice, representation in court, or any service that constitutes the practice of law, you must consult a licensed California attorney. We are happy to provide referrals to attorneys, the Santa Clara County Bar Association, or local legal aid organizations.

3 Section Three

Scope of Services

As a registered LDA, TrustPoint is authorized to provide self-help services to members of the public who are representing themselves in legal matters. The scope of our services is limited to the following:

What We CAN Do

  • Prepare legal documents at your specific direction
  • Type, format, and complete court forms accurately
  • File completed documents with the appropriate courts or agencies
  • Serve documents on opposing parties (when authorized)
  • Provide general legal information and self-help materials authored by attorneys
  • Explain procedural requirements (not legal strategy)
  • Assist with bankruptcy petition preparation under 11 U.S.C. §110
  • Refer you to a licensed attorney when appropriate

What We CANNOT Do

  • Give legal advice, opinions, or recommendations of any kind
  • Select the specific forms you need for your matter
  • Advise you on legal strategy, rights, defenses, or remedies
  • Represent you in court at any hearing, trial, or proceeding
  • Negotiate with opposing parties or their attorneys on your behalf
  • Interpret court orders, statutes, regulations, or case law for you
  • Predict the outcome of your legal matter
  • Hold ourselves out as paralegals to the public (illegal under §6452)
  • Make any guarantee or promise regarding the outcome of your matter
4 Section Four

No Attorney-Client Relationship

Use of this website, communication with TrustPoint by any means (telephone, email, text message, in-person consultation, or contact form), or engagement of our services does not create an attorney-client relationship between you and TrustPoint or any of its staff.

Information you provide to us is not protected by attorney-client privilege. We are not bound by the same confidentiality obligations as a licensed attorney. While we treat all client information with professional discretion and protect it under our Privacy Policy (Section 8), do not send us any privileged or confidential information you would not want disclosed in a court proceeding.

For legal matters that require an attorney-client privileged relationship, you must retain a licensed attorney.

5 Section Five

Right to Cancel — 24-Hour Rescission

Pursuant to California Business & Professions Code §6410(f), you have the right to cancel your service contract with TrustPoint within twenty-four (24) hours of signing it, for any reason and without penalty.

How to cancel: Send written notice of cancellation by first-class mail (postage prepaid) to our office address, OR deliver written notice in person to our office within 24 hours of signing. Mailed cancellations are effective on the date of the postmark.

Upon cancellation, we will immediately refund all fees you have paid, except for fees relating to services that were actually, necessarily, and reasonably performed during the 24-hour period — and only if you knew about and agreed in writing that we would perform those services within the 24-hour window.

6 Section Six

Fees, Refunds & Payment Terms

Flat-Fee Pricing

TrustPoint charges flat fees for document preparation services. The total fee for your matter, along with any third-party costs (state filing fees, court fees, recording fees, etc.), will be itemized in your written service agreement before any work begins.

Payment

Payment is due as outlined in your service agreement. We accept cash, check, money order, and major credit/debit cards. Returned checks are subject to a $25 fee.

Third-Party Fees

Government filing fees, court costs, recording fees, publication fees, certified copies, and similar third-party costs are separate from our service fees and are paid directly to the issuing agency. These costs are non-refundable once paid to the third party.

Refund Policy

  • 24-hour rescission — Full refund of TrustPoint fees if you cancel within 24 hours of signing (see Section 5)
  • Before work begins — Full refund of TrustPoint fees minus a reasonable consultation fee, if applicable
  • After work has begun — Refund of unearned portion of TrustPoint fees only; work already performed is non-refundable
  • Third-party costs — Government fees, court costs, and similar third-party charges are not refundable once paid
  • Completed services — Once your documents are prepared and delivered, fees for those services are non-refundable

Refund requests must be made in writing to our office. We will process valid refund requests within 30 days.

If you have a billing dispute, please contact us first at (408) 766-3532 so we can attempt to resolve the matter directly.

7 Section Seven

Website Terms of Use

By accessing or using trustpointdisabilityandlegalservices.com (the "Website"), you agree to be bound by these Terms of Use. If you do not agree, please do not use this Website.

Permitted Use

This Website is provided for informational purposes only. You may view, download, and print pages from this Website for your personal, non-commercial use, provided you do not modify the content and you retain all copyright and proprietary notices.

Prohibited Use

  • Information you provide — name, address, phone number, email, date of birth, Social Security Number (when required for specific filings), case details, and other information necessary to prepare your documents
  • Identification documents — government-issued ID, passports, immigration documents, and similar items required for verification or filing
  • Website usage data — IP address, browser type, pages visited, and similar analytics data collected automatically
  • Cookies — small data files stored on your device to enable website functionality and analytics

How We Use Your Information

Your information is used solely for:

  • Preparing and filing your legal documents

  • Your use of or inability to use our services or this Website
  • Errors or omissions in any documents prepared at your direction
  • Decisions you make based on information from this Website
  • Any actions taken or not taken by courts, government agencies, or third parties
  • Any unauthorized access to or alteration of your information

In no event shall TrustPoint's total liability to you exceed the amount you paid us for the specific service giving rise to the claim.

Fingerscan Digital Inc. Partnership

TrustPoint partners with Fingerscan Digital Inc., a separate California corporation that provides Live Scan fingerprinting, FBI channeling, ink card services, apostille services, mobile notary, business tax preparation, and process serving. Fingerscan Digital is a separate legal entity with its own terms, privacy policy, and pricing. Their services are governed by their own agreements, not these Terms.

11 Section Eleven

Bilingual Services Notice

TrustPoint provides services in English, Spanish, and Vietnamese. Pursuant to California Business & Professions Code §6410(c), if oral negotiations leading to a service agreement were conducted in a language other than English, the written contract will be provided in that language as well.

12 Section Twelve

Governing Law & Venue

These Terms and any service agreement between you and TrustPoint shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles.

Pursuant to California Business & Professions Code §6409.1, the venue for any action arising out of a dispute between TrustPoint and a client shall be the county in which the client has their primary residence.

Dispute Resolution

Before initiating any legal action, you agree to first attempt to resolve the dispute informally by contacting us at (408) 766-3532 or info@trustpointdisabilityandlegalservices.com. We will work in good faith to resolve concerns within 30 days.

Reporting Concerns

If you believe you have been a victim of fraud, the unauthorized practice of law, or any other injury related to legal document preparation services, you may contact:

14 Section Fourteen

Changes to These Terms

TrustPoint reserves the right to modify these Terms at any time. Changes will be effective when posted on this Website with an updated "Last Updated" date. Your continued use of our Website or services after changes are posted constitutes your acceptance of the modified Terms.

Material changes to these Terms will be brought to your attention through a notice on our homepage or via email if you have an active service agreement with us. We encourage you to review this page periodically.

Severability

If any provision of these Terms is held to be invalid or unenforceable, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall continue in full force and effect.

Entire Agreement

These Terms, together with any signed service agreement you have with TrustPoint, constitute the entire agreement between you and TrustPoint with respect to your use of our Website and services. They supersede all prior agreements, communications, or understandings.
