Why a Living Trust Matters

What Happens to Your San Jose Family
Without a Living Trust?

Most people assume a will protects their family. In California, it doesn't โ€” not completely. Here is what your loved ones face if you pass away without a properly funded living trust.

Living trust San Jose estate planning documents TrustPoint LDA

Without a Living Trust, Your San Jose
Estate Goes Through Probate Automatically

In California, any estate worth more than $184,500 must go through probate if it is not held in a trust. A will alone does not avoid this. Probate is a public court process โ€” anyone can look up what you owned and who receives it.

Probate Takes 12โ€“18 Months

Your family cannot access your home, bank accounts, or assets until the court process concludes. Bills still come. Mortgage payments still come. Your family waits โ€” often with no income from your estate.

Attorney & Court Fees Consume Your Estate

California probate fees are set by statute โ€” 4% of the first $100,000, 3% of the next $100,000, and so on. On a $900,000 San Jose home, statutory fees alone can exceed $25,000 before your family receives a dollar.

Medi-Cal / Medicaid Recovery โ€” Government Can Claim Your Assets

If you or your spouse received Medi-Cal benefits, the state of California can file a claim against your estate after death to recover costs. Without a trust, your home โ€” your largest asset โ€” may be at risk. A properly structured trust can help protect against recovery claims.

Creditors Can Go After Your Estate

During probate, creditors have the legal right to file claims against your estate. Your heirs may receive significantly less than you intended after outstanding debts are satisfied through the probate process.

What Is Probate โ€” And Why San Jose & Bay Area Families Need a Living Trust to Avoid It

Probate is the court-supervised process of authenticating a will, inventorying assets, paying debts and taxes, and distributing what remains to heirs. Even with a valid will, your estate does not skip this process in California.

The average San Jose home is worth over $1 million. That means the statutory probate attorney fee on your home alone โ€” before anything else โ€” can exceed $23,000. Add court fees, executor fees, and the time your family spends waiting, and the cost of not having a trust becomes very real.

A revocable living trust, properly funded, passes your assets directly to your beneficiaries โ€” privately, without court involvement, typically within 30 to 90 days.

Medi-Cal Warning for San Jose Living Trust Holders & Property Owners

If you, your spouse, or a parent has received Medi-Cal (California Medicaid) benefits โ€” especially for nursing home or long-term care โ€” the California Department of Health Care Services has the right to file a claim against your estate after death to recover the cost of those benefits. This is called Medi-Cal Estate Recovery.

If your home is not in a trust, it is subject to probate โ€” and during probate, Medi-Cal's recovery claim can be filed against it. Your children or heirs may lose the home entirely. Early planning is the only reliable protection. A properly structured trust or other planning strategy should be put in place well before Medi-Cal coverage begins.

We are not attorneys and cannot provide legal advice. If your situation involves Medi-Cal recovery or complex elder care, we will refer you to a licensed estate planning attorney. For most families, however, getting a basic revocable living trust in place now is a critical first step.

Questions & Answers

Living Trust FAQ
โ€” San Jose & Santa Clara County

Answers to the questions San Jose families ask most before setting up their trust.

What is a revocable living trust and how does it work?
A revocable living trust is a legal document you create during your lifetime that holds your assets โ€” your home, bank accounts, investments โ€” on behalf of your beneficiaries. You remain in full control as the trustee while you are alive and capable. If you become incapacitated, your successor trustee steps in seamlessly. When you pass away, your successor trustee distributes your assets directly to your beneficiaries without court involvement. It is "revocable" because you can change or cancel it at any time. See our living trust pricing in San Jose for flat-fee package details.
Is a will enough in California? Why do I need a trust?
A will is not enough on its own. In California, any estate worth more than $184,500 must go through probate if held only by a will โ€” and that threshold is easily exceeded by a single San Jose home. Probate is time-consuming (12โ€“18 months), expensive (2โ€“4% of estate value in statutory fees), and completely public. A living trust avoids all of this by transferring assets directly without court involvement.
Can an LDA legally prepare a living trust in California?
Yes. California Business & Professions Code ยง6400 authorizes a registered Legal Document Assistant to prepare living trust and estate planning documents at your specific direction. TrustPoint holds LDA #268 in Santa Clara County, is registered and bonded, and is a member of CALDA (California Association of Legal Document Assistants). We cannot provide legal advice โ€” if your situation involves complex tax planning, blended family issues, or significant business interests, we will refer you to a licensed estate planning attorney. For the vast majority of San Jose families, our service is precisely what is needed.
What is the difference between an individual and joint living trust?
An individual trust ($950) is for a single person. A joint trust ($1,500) is created by a married couple and holds both spouses' assets together. With a joint trust, if one spouse passes away, the surviving spouse retains full control of the trust without any court process. Upon the death of the second spouse, assets pass directly to your named beneficiaries. The joint package includes all documents โ€” pour-over will, power of attorney, and healthcare directive โ€” for each spouse.
Does my home automatically go into the trust when I create it?
No โ€” and this is a critical point many people miss. Creating the trust document is only the first step. For your home to be protected by the trust, a trust transfer deed must be prepared and recorded with the county recorder. This deed changes the title of your property from your name to your trust's name. Without this step, your home still goes through probate. We offer trust transfer deed preparation and same-day e-recording as an add-on service: deed preparation $275 + $50 e-recording fee + applicable county fees.
How long does it take to prepare a living trust?
Most living trust packages are completed within 3โ€“5 business days from the time we receive your completed questionnaire. Rush service is available. Once your documents are ready, you come in to review and sign โ€” notarization is done on-site. If you are adding a property transfer, the trust transfer deed can be electronically recorded the same day you sign.
Can I change my trust after it is created?
Yes. A revocable living trust can be amended or revoked at any time while you are alive and have mental capacity. Life changes โ€” marriage, divorce, new children or grandchildren, new assets โ€” often prompt people to update their trust. We can prepare trust amendments at a separate flat fee. Keeping your trust current is just as important as creating it.
What does Medi-Cal estate recovery mean for my home?
If you received Medi-Cal benefits โ€” particularly for nursing home, assisted living, or home health care โ€” the California Department of Health Care Services can file a claim against your estate to recover the costs paid on your behalf. If your home goes through probate (i.e., it was not in a trust), it is part of your estate and subject to that claim. Your heirs may be required to sell the home to satisfy the state's recovery claim. Early planning is the most effective protection. We strongly recommend a consultation before any Medi-Cal benefits begin for situations involving property and estate recovery. We are not attorneys; if your situation is complex, we will refer you to a licensed elder law attorney.
Do you offer services in Spanish or Vietnamese?
Yes. TrustPoint provides complete living trust preparation services in English, Spanish, and Vietnamese. Every consultation, questionnaire review, and document signing appointment is available in your preferred language. We proudly serve San Jose's diverse communities throughout Santa Clara County.
