What Is a Quitclaim Deed in California?

A quitclaim deed transfers whatever ownership interest the grantor has in real property to the grantee — without any warranties about the title. It is the fastest and simplest way to transfer property between family members, in a divorce, into or out of a trust, or to clear up title issues.

What is a quitclaim deed?
A legal document that transfers whatever ownership interest the grantor has in real property to the grantee — without any warranties about the title. Commonly used for family transfers, divorce property division, trust funding, and clearing title defects in California.
Will it trigger property tax reassessment?
It depends on the transfer type. Transfers between spouses, into your own trust, or certain family transfers may be excluded from Prop 13 reassessment. We prepare the PCOR with the correct exclusion codes. For spousal transfers, consider an interspousal deed for stronger tax protection.
When should I use a grant deed instead?
Use a grant deed when selling property to a third party — it provides basic title warranties. For non-sale transfers between family, in divorce, or into a trust, a quitclaim deed is simpler and sufficient.
