What Is Probate & Why Do You Need It?

Probate is the court-supervised legal process for administering a deceased person's estate in California. It involves proving the validity of a will (if one exists), identifying heirs, paying debts and taxes, and distributing assets to beneficiaries.

In California, probate is required when the deceased did not have a living trust and the estate exceeds $208,850 in probate assets. Without proper filings, the estate cannot be settled, property cannot be transferred, and heirs cannot receive their inheritance.
